Acceptance
These are the terms for using theStacc — the AI SEO platform that writes articles, publishes them to your site, manages your Google Business Profile, and ships posts to your social channels. theStacc is operated by theStacc Software Pvt. Ltd., a company registered in Jaipur, Rajasthan, India.
By signing up, starting a trial, or clicking the button that says you accept these terms, you agree to everything on this page. If you are signing up on behalf of a business, you confirm that you have authority to bind that business to these terms.
If you do not agree with something here, do not use the product. Email us at hello@thestacc.com if you want to negotiate a different arrangement — we read every email and reply within 24 hours.
Your account
To use theStacc you need an account. When you create one, you agree to a few things:
- You give us accurate information — your real name, your real business name, a working email address.
- You keep your password to yourself. If someone else gets access through your password, anything they do counts as something you did.
- You tell us within 48 hours if your account is compromised. Email hello@thestacc.com.
- You are at least 18 years old and legally able to enter a contract in your country.
- One person, one account. Don't share logins across a team — invite teammates instead.
We can suspend or close your account if you break these rules. We will tell you why and give you a chance to fix it, unless the problem is severe enough that immediate action is required.
License to use
While your subscription is active and paid up, we give you a non-exclusive, non-transferable, worldwide license to use theStacc for your business. That license covers the dashboard, the API, the integrations, and the published content we generate for you.
You do not own the platform. We do. You cannot copy the code, reverse-engineer the product, resell access, or build a competing product on top of ours. You also cannot use our trademarks, our logo, or the theStacc name in your own marketing without written permission.
Everything you can do inside the product is fair game. Everything outside it — copying, scraping, reselling — is not.
Acceptable use
theStacc exists to help honest businesses publish honest content. It is not a tool for spam, fraud, or harm. The following are not allowed:
- Publishing content that is illegal in the country where your business operates or where the content will be read.
- Publishing content that infringes someone else's copyright, trademark, or trade secret.
- Publishing content that is defamatory, harassing, hateful, or targets a protected group.
- Publishing sexually explicit content, content about minors in a sexual context, or content that promotes self-harm.
- Publishing medical, legal, or financial advice presented as professional counsel when it is not.
- Running automation that overloads our servers, scrapes our content, or probes for vulnerabilities. If you find a vulnerability, email hello@thestacc.com — we will say thank you.
- Using theStacc to generate content for a network of doorway pages, link farms, or anything else designed to manipulate search engines.
- Reselling your account or sharing it with another business.
If we find you doing any of the above, we will close your account, keep the money you have paid for the current billing period, and report the activity to the relevant authority if the law requires it.
Subscription & billing
theStacc is a monthly or annual subscription. The price for your plan is shown on the pricing page and on the checkout screen before you pay. Stripe processes every transaction.
- Monthly plans renew on the same day every month. The first charge happens the day you sign up.
- Annual plans renew on the same day every year. We email a reminder 14 days before each renewal.
- free trial — if you signed up for a free trial, the trial price covers the first month. After the trial month ends, the regular monthly price kicks in. We email you 3 days before the first full charge.
- Taxes are added at checkout based on your billing address. We collect GST in India, VAT in the EU and UK, and sales tax in US states where required.
- Failed payments — we retry the card 3 times over 7 days. If all three fail, the account pauses until you update billing. Published content stays live during the pause.
- Price changes apply at your next renewal. We email you at least 30 days before any price increase.
- Refunds — we offer a 14-day money-back guarantee on first-time annual plans. Monthly plans are not refundable, but you can cancel before the next renewal.
Cancellation
You can cancel from the billing page in the dashboard at any time. There is no cancellation fee and you do not need to email us — but if you want to tell us why you are leaving, we will read every word.
- If you cancel a monthly plan, it stays active until the end of the current billing period. You will not be charged again.
- If you cancel an annual plan, it stays active until the end of the year you paid for. We do not refund unused months.
- Once the plan ends, the dashboard goes read-only for 90 days. After 90 days the account is deleted unless you reactivate.
- Articles, GBP posts, and social posts published to your channels before cancellation stay live on those channels. We do not remove them.
Content ownership
This is the section every customer asks about. Read it carefully.
Content you give us
The brand voice samples, existing blog posts, customer logs, product docs, target keywords, and any other input you upload or paste into the platform stay yours. You give us a limited license to use that material to operate the product for you — write articles, build internal linking, suggest keywords, train your brand-voice model. We do not use your material to train a public model or share it with any other customer.
Content theStacc generates
Articles, GBP posts, social posts, meta descriptions, schema markup, and any other text or image the platform produces for you ("generated content") are owned by theStacc the moment they are created. The moment a piece of generated content is approved and published to your site or your channel, theStacc grants you a perpetual, worldwide, royalty-free, transferable license to use, edit, republish, syndicate, translate, monetize, and sub-license that piece of content for any purpose. The license survives cancellation of your subscription.
In plain English: theStacc owns the underlying IP, but once a piece of content is approved and goes live, you can do whatever you want with it forever. You can keep it on your site, republish it, edit it, syndicate it to other publishers, sell the rights to someone else. Cancelling your subscription does not retroactively pull a license — every article that went live during your subscription stays yours to use.
If your business is acquired, the license follows the business. If you sell the article rights to a third party, the license follows the rights.
Why we structure it this way
Most AI content platforms claim joint or unclear ownership. We split it cleanly: theStacc owns the underlying IP so we can defend it against copycats and infringement, you get a perpetual license so the content is permanently safe to use. The license terms are written so a court reading them will land on the side of you, the customer.
Disclaimers
theStacc is a tool. Tools have limits. Here is what we do not promise:
- We do not guarantee a specific Google ranking. SEO is influenced by hundreds of variables outside our control — your domain age, your backlinks, your competitors, and Google's algorithm itself.
- We do not guarantee that AI-written content will pass every fact-check, plagiarism check, or AI-detector check. We do our best, but you should review every article before approval.
- We do not guarantee continuous uptime. We target 99.9% but the platform may be down for maintenance, third-party outages (AWS, Stripe, SendGrid), or events outside our control.
- We do not provide tax, legal, medical, or financial advice. Content generated by theStacc is for informational purposes only.
- The platform is provided "as is" and "as available". To the maximum extent allowed by law, we disclaim all warranties — express, implied, statutory, or otherwise — including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent allowed by law:
- theStacc is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. That includes lost profits, lost data, lost rankings, lost revenue, and loss of goodwill.
- Our total liability for any claim arising out of these terms or your use of the product is capped at the amount you paid us in the 12 months before the claim arose, or $500 — whichever is greater.
- This cap applies whether the claim is in contract, tort, statute, or any other legal theory.
Some jurisdictions do not allow this kind of limit. If you are in one of those jurisdictions, the limit applies to the maximum extent that the law allows.
Termination
You can terminate by cancelling from the dashboard. We can terminate by sending you an email and a 30-day notice, except in cases of severe breach — fraud, abuse, illegal content, security threats — where we can terminate immediately.
When termination happens:
- Your access to the dashboard ends.
- Your published content stays where it is — on your site, on your GBP profile, on your social channels.
- Your data in our database is deleted within 90 days, except billing records (kept 7 years) and security logs (kept 12 months).
- The content license described above survives — every article approved and published during your subscription stays licensed to you forever.
- Sections of these terms that should reasonably survive — payment, ownership, liability, disputes — do survive.
Disputes
If something goes wrong, email hello@thestacc.com first. We try to resolve everything by email within 30 days.
If email does not resolve it:
- These terms are governed by the laws of India.
- The courts of Jaipur, Rajasthan, India have exclusive jurisdiction over any dispute, except where mandatory consumer protection law in your country gives you the right to sue locally.
- Before filing a lawsuit, both parties agree to spend 60 days trying to resolve the dispute through good-faith negotiation.
- You waive any right to bring a class action. Every claim is brought individually.
Changes
We update these terms when the law changes, when we ship a new feature, or when we need to fix something that is unclear. Every update lands here with a new "last updated" date at the top.
If a change reduces your rights or increases your obligations, we email everyone with an active account at least 30 days before the new terms take effect. If you keep using the product after that 30-day window, you accept the new terms. If you do not accept them, cancel before the window ends and we will refund any pre-paid amount that covers time after the new terms take effect.
